TERMS AND CONDITIONS

1. Agreement to Terms and Host Agency Disclosure

These Terms and Conditions (“Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“User,” “you,” or “your”), and CruiseThirty, LLC, an Independent Contractor of Cornerstone Collective (referred to herein as the “Host Agency,” and with CruiseThirty, LLC, collectively as “Company,” “we,” “us,” or “our”), concerning your access to and use of the CruiseThirty website and any other services, media forms, media channels, mobile websites, or mobile applications related, linked, or otherwise connected thereto (collectively, the “Service”).

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND MUST DISCONTINUE USE IMMEDIATELY.

2. Services Offered (Agency Role)

CruiseThirty, LLC acts strictly as an agent for third-party travel providers, including, but not limited to, cruise lines, airlines, hotels, and tour operators (collectively, “Suppliers”).

• Agency Role and Host Agency Disclosure: We facilitate the booking of travel services as an Independent Contractor of Cornerstone Collective. CruiseThirty, LLC is required to, and does, operate under the Host Agency’s licensing, accreditation, and bonding. You acknowledge that your booking is ultimately processed through the Host Agency’s operational framework.

• Supplier Responsibility: You acknowledge that the Suppliers are solely responsible for providing the booked travel services. CruiseThirty, LLC and Cornerstone Collective make no guarantees or warranties regarding the Suppliers’ services, products, reliability, or safety. Your contract for the travel services is directly with the respective Supplier.

• Terms of Suppliers: All bookings are subject to the terms and conditions, contracts, and tariffs of the individual Suppliers. You are responsible for reviewing and agreeing to these Supplier terms prior to booking.

3. User Representations and Eligibility

By using the Service, you represent and warrant that:

• You have the legal capacity to enter into these Terms.

• You are at least eighteen (18) years of age.

• All registration information you submit is true, accurate, current, and complete.

• You will maintain the accuracy of such information and promptly update it as necessary.

• You will not use the Service for any illegal or unauthorized purpose.

• You will not use the Service in any manner that violates any applicable law or regulation.

4. Booking and Payment

• Accuracy of Information: You are responsible for ensuring that all names, dates, and other details provided to us for booking purposes exactly match the information on your valid travel documents (e.g., passport, ID). Errors may result in denied boarding or financial penalties.

• Pricing: Quoted prices are subject to change without notice until a booking is confirmed and payment is processed.

• Deposits and Final Payment: You agree to abide by the payment schedules (deposit and final payment due dates) set by the respective Supplier. Failure to make payments on time will result in automatic cancellation of the booking and forfeiture of any previous payments, according to the Supplier’s cancellation policy.

5. Cancellation, Changes, and Refunds

• Supplier Policies Govern: All cancellations, changes, and refund requests are strictly governed by the policies of the respective Supplier. These policies often involve significant cancellation penalties.

• Agency Fee: In addition to any Supplier penalties, CruiseThirty, LLC may assess a separate administrative fee for processing cancellations or changes. This fee will be disclosed to you prior to or at the time of booking.

• Refunds: Refunds are processed only after they are received from the Supplier and are subject to their processing times.

6. Disclaimer of Warranties

The Service is provided on an AS-IS and AS-AVAILABLE basis. You agree that your use of the Service will be at your sole risk. To the fullest extent permitted by law, we disclaim all warranties, express or implied, in connection with the Service and your use thereof, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

CruiseThirty, LLC makes no warranties or representations about the accuracy or completeness of the website’s content or the content of any websites linked to this website.

7. Limitation of Liability

In no event will CruiseThirty, LLC or Cornerstone Collective, or their directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any cause whatsoever, regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the Service during the one (1) month period prior to any cause of action arising.

8. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates (including Cornerstone Collective), and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of:

• Your use of the Service.

• Breach of these Terms.

• Your breach of the representations and warranties set forth in these Terms.

• Your violation of the rights of a third party, including but not limited to intellectual property rights.

• Any harmful act toward any other user of the Service.

9. Governing Law and Dispute Resolution

These Terms and your use of the Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Comal County, Texas.

10. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service.
